Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) are a binding agreement between you (“User”, “you”) and Charme Dance AI (“we”, “us”, or “our”). By accessing the website, creating an account, uploading a photo, generating a video, purchasing credits, or using another feature, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the service.

2. Service Description and AI Provider Disclosure

Charme Dance AI is an online generative-AI tool that transforms one authorized portrait photo into a 15-second reference-guided dance video. Output is available in 9:16, 16:9, or 1:1 format at 480P, 720P, or 1080P.

Video generation is powered by Wan 3.0 through KIE AI.

• The uploaded portrait is intended to replace the central lead dancer while the reference video guides full-body choreography, ensemble movement, timing, camera behavior, and stage atmosphere.
• AI generation is probabilistic. Facial detail, hands, clothing, backgrounds, and movement may change between frames or attempts.
• We may adjust technical parameters or discontinue features when reasonably necessary to operate, secure, or improve the service.

3. Eligibility and Portrait Authorization

• You must be at least 18 years old to use generation features.
• You must be the person shown in the uploaded photo, or you must have explicit permission from that adult to use their likeness for AI video generation.
• Photos of minors, non-consenting adults, or public figures used without required rights are prohibited.
• You are responsible for securing your account credentials and for activity under your account.

4. Credits, Prices, and Failed-Task Returns

• Video generation uses credits: 480P costs 10 credits, 720P costs 20 credits, and 1080P costs 40 credits per video.
• Credits may be reserved when Generate Video is submitted.
• If a task is confirmed failed before producing a result, reserved credits are returned according to the current service rules.
• One-time-pack credits do not expire under the currently displayed product terms.
• Subscription credits are valid for the active billing period and do not roll over unless the product states otherwise.
• A credit return for a failed AI task is not a cash refund. Payment refunds are governed by the Refund Policy.

5. User Content and License

You retain rights you hold in uploaded photos and generated outputs. You grant us a temporary, non-exclusive, worldwide license to process, transmit, store, display, and deliver the content solely as needed to operate the requested service, secure the platform, resolve disputes, and comply with law.

You represent that you have the rights and permissions needed to upload the photo and request the generation.

6. Acceptable Use Policy

You may not upload, request, create, publish, or promote content that:

1. Is pornographic, nude, sexually explicit, or sexualizes a minor.
2. Depicts child sexual abuse material. This is prohibited without exception and may be reported to appropriate authorities.
3. Depicts graphic violence, gore, credible threats, harassment, hate, or illegal activity.
4. Uses another person’s likeness without consent, misrepresents identity, impersonates a real person, or facilitates fraud.
5. Violates privacy, publicity, copyright, trademark, or other rights.
6. Is designed to evade safety checks, abuse the service, distribute malware, scrape private data, or disrupt infrastructure.

Automated Moderation and Request Refusal

Before video generation, uploaded images are submitted to an automated image-safety moderation request using OpenAI’s moderation service. If a photo is flagged, the generation request is rejected and no video task should proceed. If moderation is unavailable, the request may fail closed rather than proceed without a check.

We may also refuse, suspend, or terminate requests involving suspicious, unlawful, non-consensual, or high-risk use, even when an automated check does not identify every issue. We do not claim that automated moderation detects all prohibited content.

Content Reports and Investigation

Anyone may report suspected unauthorized likeness use, inappropriate generated content, privacy violations, or other abuse to support@charmedanceai.app. Reports should include the relevant URL, a description, and any order or account information needed to locate the content. We review reports, may request verification, and may restrict access while investigating. We aim to acknowledge reports within 2 business days and prioritize urgent safety reports.

7. Account Suspension and Termination

We may issue a warning, remove or restrict content, limit features, suspend an account, or terminate access when we reasonably believe a user has:

• Uploaded a minor, non-consenting person, or unauthorized public figure.
• Requested sexual, violent, hateful, harassing, fraudulent, or otherwise prohibited content.
• Repeatedly attempted to bypass moderation or rate limits.
• Used the service for impersonation, non-consensual intimate content, or other serious abuse.
• Violated intellectual-property, privacy, payment, security, or platform-integrity rules.
• Created risk to other users, providers, or the service.

The response may depend on severity, evidence, recurrence, legal obligations, and immediate safety risk. Serious violations can result in immediate suspension or termination without a prior warning.

Content and Credits After Enforcement

We may remove or disable access to content associated with a violation and preserve records needed for investigation, security, chargeback handling, or legal compliance.

Except where applicable law requires otherwise, unused purchased credits may be frozen or forfeited when an account is suspended or terminated for a material Terms violation. We will try to distinguish credits connected to an investigated violation from unrelated balances when practical. Subscription access may also end when the account is terminated for violation, without refund except where law requires otherwise.

Appeals and Contact

An affected user may appeal by emailing support@charmedanceai.app with the account email, the action taken, and any information relevant to the review. We may uphold, modify, or reverse an action after review. Urgent safety, repeat violations, and severe unlawful conduct can limit or exclude reinstatement.

8. Copyright and Likeness Complaints

If you believe content infringes your copyright, privacy, or likeness rights, contact support@charmedanceai.app with the URL, a description of the protected work or identity interest, your relationship to it, and a good-faith explanation of the concern. Knowingly submitting a false or abusive report is prohibited.

9. Disclaimer of Warranties

The service is provided “AS IS” and “AS AVAILABLE.” To the extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

10. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the service. Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded.

11. Changes and Contact
